Welcome to www.surfaceplus.com, Surface+ or Surface Plus (the "Site"), an interactive service associated with other interactive activities to build community based on topics related to architecture, architectural materials, architectural surfaces, and information which is operated by Architectural Surfaces SA de CV (hereinafter, "We", "our website" or "the site").

1.0 Users

Users will be called Visitors and Exhibitors

Users upon entering and/or registering accept these Terms of use, which are backed by good and valuable consideration whose receipt and sufficiency is hereby acknowledged. Such consideration includes, without limitation, your use of the Site and the Content available therein. In addition to these Terms of use, Architectural Surfaces SA de CV has established a "Privacy Notice" to explain how it collects and uses Users' information. You can find a copy of this Privacy Notice here, and it is incorporated by reference into these Terms of use. By accessing, registering, or using the Site, you express your acknowledgment and acceptance of Architectural Surfaces SA de CV's Privacy Policy and Terms of use.

If you register to become a Surface+ member, you are responsible for maintaining the confidentiality of your user email and password information, as well as restricting access to your computer. You agree to assume responsibility for all activities that occur under your user email and password.

1.01 Visitors

  • Visitors accept that the products and services displayed on the Website are presented exclusively by Exhibitors, and any information obtained is the total responsibility of the Exhibitor for informational purposes. The Website, its administrators, and Architectural Surfaces S.A. de C.V. are not responsible for such information or data.
  • Visitors acknowledge that they cannot take legal action against the Site for errors, inaccuracies, falsehoods, or misinformation related to products or services offered by Exhibitors.
  • Visitors must use the Website information in accordance with current regulations, refraining from acts that may violate the privacy, reputation, or rights of third parties.
  • Reproduction of any type of Website content is prohibited whether for collective, professional, business, or commercial uses, including internal networks such as intranets or extranets, unless expressly authorized by Architectural Surfaces SA de CV.
  • The Site, its sections, and its subdomains may not be integrated, totally or partially, into other Internet sites without prior authorization.
  • Any breach of these provisions will be sanctioned in accordance with applicable legislation of the United Mexican States and international intellectual property laws.

1.02 Exhibitors

Natural or legal persons who request the service to display products or services related to architectural surfaces, design, or installation (hereinafter, the "Exhibitors") must provide the following personal data: full name, landline and mobile phone, email, profile type, country, state, city, company name, and company website.

Additionally, Exhibitors must provide in writing the information corresponding to the contracted plan to enable their microsite, respecting the design and quality guidelines established by Architectural Surfaces SA de CV. It is the Exhibitor's responsibility to ensure that the information provided is real and accurate to ensure it is always clear, complete, and current.

The Site establishes strict criteria to regulate the products and services that can be exhibited. These must comply with applicable laws and current regulations in the corresponding region. The following products are not allowed to be published:

  • Materials obtained illegally or counterfeit Includes products that imitate recognized brands without authorization, such as panels, floors, or coatings of dubious origin.
  • Second-hand materials not suitable for structural or architectural use: Except those classified as recovered, vintage, or with historical value for specific projects.
  • Defective or recalled products: Includes those manufactured with prohibited materials or that do not meet safety regulations.
  • Dangerous or explosive materials: For example, unapproved chemicals for construction that pose risks.
  • Products that infringe intellectual property rights: Such as exclusive designs replicated without authorization.
  • Materials with misleading descriptions, brands, or images: Includes products that promote false properties or use offensive content.

It is essential that Exhibitors own or have valid licenses for the use of photographs and images they provide. In cases where these represent works protected by copyright, the Exhibitor must obtain prior authorization from the corresponding rights holder.

Neither the Site nor its administrators, owners, or the brands Surface+, Surface Plus, or Architectural Surfaces SA de CV assume responsibility for incorrect, false, or fraudulent information published by Exhibitors. They are also not responsible for damages or harm that such information may cause to Visitors or third parties. In this regard, Architectural Surface SA de CV and the Site do not guarantee the accuracy, truthfulness, or reliability of content related to products and services offered by Exhibitors.

3.0 Intellectual Property

3.01 Website Intellectual Property.

The Website, the material and content it includes (and any derivative work or improvement thereof), whether generated by Architectural Surfaces SA de CV, obtained from its licensors, and/or other sources, is protected by trademark and copyright laws of the United Mexican States, and international treaties that homologate local provisions such as texts, illustrations, files, images, software, scripts, graphics, photos, sounds, music, videos, information, materials, products, services, URLs, technology, documentation, and interactive features (hereinafter, the "Content"), as well as all associated intellectual property rights, are the exclusive property of Architectural Surfaces SA de CV.

All trademarks, service marks, trade names, and trade images present on the Site are also property or are under trademark use license contract of Architectural Surfaces SA de CV, our licensors, or both. You acknowledge and agree that:

  • The stylized trademarks of Surface+, Surface Plus including the logo and related graphics (hereinafter, "Our Marks"), are the property of our licensor under trademark contract temporarily granted to Architectural Surfaces SA de CV and cannot be used without prior authorization.

Except for the limited licenses granted herein, Architectural Surfaces SA de CV reserves all rights to its Our Technology, Content, and Our Marks.

3.03 Website Access and Use.

Access to the Site, including the Content, is available exclusively for informational and personal use purposes. By using the Site, you agree to comply with all applicable laws, including copyright laws.

Unless expressly authorized in these Terms of use, it is prohibited to:

  • Reproduce, distribute, create derivative works, publicly display, publicly perform, publish, transmit or otherwise exploit the Site's Content.

Therefore, Architectural Surfaces SA de CV will have the non-exclusive right to use, copy, distribute, and disclose such content for any purpose, in any medium and worldwide.

You accept that Architectural Surfaces SA de CV acts as a passive channel for the distribution of User-Generated Content and assumes no responsibility for its content or accuracy. The opinions or comments included in this content do not necessarily represent those of Architectural Surfaces SA de CV, and their use will be at your own risk.

By submitting content, you declare that it is of your authorship, does not infringe third-party rights (intellectual property, privacy, or personality) and does not include defamatory statements. Additionally, you warrant that you have the capacity to grant the mentioned license.
